Terms of Use

1. Acceptance

These Terms of Use (“Terms”) govern your use of Spot, including the app, App Clip, website, and related services (the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and to the Privacy Policy.

2. The Service

Spot lets an organiser create a shared event-photo album called a “Film.” Guests can join through an invitation link, QR code, or App Clip; capture photos in the app; and view photos shared with that Film. Films may use capture limits, photo styles, a timed reveal, co-organisers, invitation cards, QR codes, gallery saving, and iOS system sharing.

Spot is not a professional photography, archiving, or backup service. Keep your own backup of any photo that matters to you.

3. Eligibility and Accounts

You must be at least 13 years old to use the Service. If local law requires parental or guardian consent for you to use an online service, you must obtain it before using Spot.

Spot may create an anonymous account for your device. You may also use email, Sign in with Apple, or Google Sign-In. You are responsible for keeping access to your device and account secure and for promptly reporting unauthorised use to us.

You can delete your account in the app through Settings > Account > Delete Account. Account deletion removes your account data and the content uploaded by your account, except where retention is required by law. Deleting an account does not cancel an App Store purchase; there are no recurring subscriptions in Spot.

4. Films, Invitations, and Access

Organisers control their Film’s settings, including its name, date, reveal time, participant and capture limits, camera style, invitations, and co-organisers. Anyone with an invitation link or QR code may be able to join, so organisers and guests must share them carefully.

Photos and display names in a Film are visible to people with access to that Film. People may save photos to their device or share them outside the Service; Spot cannot control content once it leaves the Service.

5. Your Content

You keep ownership of the photos and other content you upload (“User Content”). You give Spot a limited, non-exclusive, worldwide, royalty-free licence to host, store, copy, process, style, display, and deliver your User Content only as needed to operate and improve the Service, make it available to the Film’s authorised members, enforce these Terms, and comply with law.

You confirm that you have all rights, permissions, and consents needed to upload and share User Content. You are responsible for obtaining permission from people you photograph, particularly children and people in private settings.

Original photos are automatically deleted 90 days after a Film ends; see our Privacy Policy for the reminder schedule. Save any photos you want to keep before then.

6. Acceptable Use

Do not use Spot to upload, share, promote, or facilitate:

We have zero tolerance for child sexual abuse material and exploitative content.

7. Reporting, Moderation, and Enforcement

You can report objectionable content or abusive behaviour through the in-app Report feature or by emailing support@spontanea.app. We review reports promptly and may remove content, restrict access, block users, suspend accounts, or cooperate with authorities where appropriate.

If there is an immediate danger or a suspected crime, contact local emergency services or law enforcement first.

8. One-Time Purchases

Spot offers free features and may offer one-time purchases such as Film, participant, or capture packages. The purchase screen shows the item, price, currency, and what it provides before you buy it. Spot does not offer auto-renewing subscriptions.

Purchases on Apple devices are processed through the App Store and may be managed through Apple. Apple handles payment-card data. Refunds are subject to Apple’s applicable refund process and any mandatory consumer rights that apply to you.

9. Intellectual Property

The Spot name, logo, app, design, software, and other Service materials belong to Spot or its licensors. We grant you a personal, limited, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service except where law permits.

10. Apple Terms

These Terms are between you and Spot, not Apple. Apple has no obligation to provide maintenance or support for the Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must comply with Apple Media Services Terms and any other applicable third-party terms when using the Service.

You confirm that you are not located in a region subject to a U.S. government embargo and are not on a U.S. government prohibited or restricted-party list.

11. Availability and Liability

The Service is provided on an “as is” and “as available” basis. We do not guarantee that it will always be uninterrupted, error-free, secure, or available. To the fullest extent permitted by law, Spot is not liable for indirect, incidental, special, or consequential losses, or for User Content, organiser actions, or sharing outside the Service.

Nothing in these Terms limits rights or liabilities that cannot lawfully be limited, including mandatory consumer rights.

12. Changes and Termination

We may update the Service or these Terms from time to time. We will give reasonable notice of material changes in the app, by email, or on spontanea.app/terms. Your continued use after the effective date means you accept the updated Terms.

We may suspend or terminate access where you violate these Terms, harm others, misuse the Service, or create a security or legal risk. You may stop using the Service or delete your account at any time.

13. Governing Law and Contact

These Terms are governed by the laws of the Republic of Türkiye, without affecting mandatory consumer-protection rules that apply where you live. Any dispute is subject to the courts and authorities determined by mandatory law.
